Suit filed against Pleasant Grove mausoleum venture A class action suit seeking return of money paid into a million dollar mausoleum venture at Pleasant Grove Memorial Cemetery between Carbondale and Murphysboro was filed Monday in Jackson County Circuit Court in Murphysboro. The suit names 13 Jackson County resident identified as people who purchased crypt space in the first of four mausoleums planned at Pleasant Grove as plaintiffs against Pleasant Grove Memorial Company, Gibraltar mausoleum Corporation of Indianapolis, and F. Burt Sharp, identified as president of Pleasant Grove.

The suit estimates about 100 people involved in similar circumstances in relation to purchase of mausoleum space, and requests the court to designate the 13 plaintiffs as class action representing all others "similarly situated." The suit claims the cemetery conducted a door-to-door sales promotion in the 1980-82 period, soliciting purchases of mausoleum space in the first of several units to be constructed. The building was started, under a contract with the Indiana firm, but work was halted in October 1982. A copy of a contract, attached to the suit, lists the cost of one space in the mausoleum at $1,330. The suit asks the court to order a refund of all payments made for space, plus costs and interest. It alleges violations by the Pleasant Grove company, including: Violation of the Federal Trade Commission's door-to-door sales rules by not providing a complete coup of" the contract to purchasers, including a lack of a cancelation notice.

Failure of Pleasant Grove to honor notices of cancelation filed by the plaintiffs between July 24, 1984, and Aug. 28, 1984, and to make refunds.
